Dispute Resolution and Jurisdiction

Mediation

The parties will first attempt to resolve the dispute through good-faith negotiations. If these negotiations do not result in an agreement within 30 days, the dispute will be referred to mediation. Both parties will mutually agree upon a neutral third-party mediator. If the parties are unable to agree on a mediator, the Company reserves the right to appoint the mediator. The mediator’s decision will be non-binding, and both parties will equally share the cost of mediation.

Arbitration

If mediation does not resolve the dispute, either party may submit the matter to arbitration. Arbitration shall be conducted by a sole arbitrator appointed by the Company, and the proceedings will take place in Port Blair, Andaman and Nicobar Islands, India. The arbitration shall be conducted in English, and the decision of the arbitrator will be final and binding on both parties. Each party will bear its own costs for the arbitration, but the arbitrator may decide on cost allocation at their discretion.

Jurisdiction

This Policy and any dispute arising from your use of www.magicalandaman.com will be governed by and interpreted in accordance with the laws of India. Any legal proceedings or arbitration shall take place exclusively in Port Blair, Andaman and Nicobar Islands, India, and the parties submit to the jurisdiction of the courts located in this region.
